On February 1, 2022, Japan's Ministry of Economy, Trade and Industry (METI) consulted to revise the Ministerial Ordinance Specifying the Method of Provision of Information on the Properties and Handling of Designated Chemical Substances, etc under the Pollutant Release and Transfer Register (PRTR) Law to allow SDS delivered via email or web in addition to fax. The deadline for comments is March 3, 2022.
Although the proposed amendment is expected to be approved and implemented by the end of March 2022, in fact companies have long been delivering SDS in digital forms with the consent of the recipient. Thus, this amendment is only to make clear the SDS delivery methods.
In Japan, the GHS system is implemented under three laws, including the ISHL, the PRTR law and the PDSCL. Under the PRTR law, the Class I substances and Class II substances are mandatory to provide SDS. In October 2021, the number of Class I substances and Class II substances was respectively increased from 462 to 515 and from 100 to 134, which will take effect from April 1, 2023.
