Korean Enterprises in Breach of CCA Now Have Six Months to Voluntarily Notify Their Breaches

On 22 Nov 2017, Korea MoE issued an announcement, urging the manufacturers and importers of hazardous chemicals to voluntarily notify breaches of the previous Toxic Chemicals Control Act (TCCA, the precursor of CCA) and the current Chemicals Control Act (CCA) 

Hazardous chemicals defined under CCA include toxic substances, restricted substances, substances subject to authorization, prohibited substances and accident precaution chemicals.

Korea MoE intends to offer 6 months to enterprises to finish rectification, including any enterprises that haven’t submitted the “written confirmation of details for chemical product” or haven’t applied for notification/permission for manufacture/import activities, etc. They will have a chance to voluntarily notify the corresponding authorities of any breaches from 22 Nov 2017 to 21 May 2018 to exempt them or reduce punitive measures as specified in CCA. If enterprises fail to notify within the given period they will be subject to severe punishments.
