Korean MoE Proposes Changes to K-REACH Enforcement Rules

The Ministry of Environment (MoE) issued a revised draft of the Ministerial Decree (Enforcement Rules) of the Act on Registration and Evaluation of Chemical Substances (K-REACH) on 10 Jul, 2015. The public consultation will end on 20 Aug.

The Ministerial Decree was drafted on 18 Feb 2014 for public consultation and finalized on 24 Dec 2014, a week before K-REACH entered into effect on 1 Jan 2015. Some details in the Ministerial Decree are controversial and pose difficulties for industry in terms of meeting the practical compliance requirements. This revision proposal has been made to facilitate the implementation of K-REACH and simplify industry compliance requirements. The main changes in the draft revolve around the following 5 aspects:

1. Reduce documentation and data submission requirements for the “application for registration exemption confirmation” of substances used for R&D purpose; the corresponding post-treatment result report can be omitted if the substance is manufactured/imported below 0.1 ton each time.

2. Allow a “one-time” confirmation of registration exemption for a reagent used for scientific study, analysis or research, instead of the current annual application requirements.

3. Change the procedure for appointing a lead registrant from the current majority vote to voluntary negotiation.

4. Change the appointment and dismissal procedures of ORs

  • Competent authority: NIER

  • Submit amendment report when changing OR, rather than the formal POA/dismissal letter

  • Product name can be used instead of chemical name in the OR application form

5. Delete duplicated items in relevant reporting and registration forms
