Malaysia Announces Regulatory Approaches on Dechlorane Plus and UV-328

Malaysia's DOE announced via myEHS that Dechlorane Plus and UV-328 are banned under Stockholm Convention obligations, with no plan to register any exemption.

The Department of Environment (DOE) Malaysia recently issued a public notice on the myEHS portal clarifying the nation’s regulatory approach to managing two persistent organic pollutants (POPs), Dechlorane Plus and UV-328, under the Stockholm Convention (SC). 

As a SC signatory , Malaysia is implementing SC obligations through Malaysia Environmentally Hazardous Substances (MyEHS) System. Dechlorane Plus and UV-328 are listed under Malaysia's EHS Reference List. The importers, exporters and/or the manufacturers of EHS in Malaysia (Malaysia registered company) shall register, apply, and notify in the MyEHS System. 

Currently, Malaysia is adhering to SC obligations which prohibits the production and use of Dechlorane Plus and UV-328, except under specific exemptions allowed by the SC. These exemptions, if applicable, must strictly adhere to the SC’s technical and procedural requirements. Stakeholders are advised to consult the SC’s official web portal for details on permissible exemptions.

Article 4 of the SC mandates that any exemptions for POPs must be formally registered with the SC Secretariat. However, since Malaysia has not ratified the convention, the nation has no plan to register any exemption for Dechlorane Plus and UV-328.
