On 8th October 2019, Shanghai Municipal Bureau of Ecology and Environment published an Explanation [1] to the Announcement [2] on the Implementation of National Special Emission Limits Standards for Atmospheric Pollutants in Key Industries. The Announcement, which was released in September this year, stipulates key industries subject to the special emission limits standards. The implementation time for enterprises established in different periods is also specified in the Announcement.
So far, there are 28 sector-specific national emission control standards in force, involving the thermal power industry, steel industry, petrochemical industry, cement industry, non-ferrous metal industry, chemical industry, boiler industry, pharmaceutical industry, and paint, ink and adhesive Industry. The Standard for Fugitive Emission of Volatile Organic Compounds is also included. While the Shanghai Municipal Government urges the above-mentioned industries to comply with the corresponding emission standards, it also integrates the packaging and printing industry and the industrial coating industry into key management targets.
The enterprises that have been established before the standards come into effect will be given a grace period to adapt to the new requirements. For the enterprises established before MEP Notice on Implementation of Special Emission Limits for Atmospheric Pollutants (No. 14 in 2013), they will be required to comply with the requirements for special pollutants by no later than 1st July 2020. All newly established enterprises are required to meet the requirements for all pollutants as soon as the standards enter into effect. The standards' implementation time and the special conditions for enterprises can be found in the annex of the Announcement.
Compared with Jiangsu and Zhejiang Province, which have also already implemented these national emission control standards, Shanghai has stipulated some local standards with stricter requirements for several key industries. If the national standards for these key industries are revised to be stricter than Shanghai's local standards, the local standards will be revised. Under these circumstances’ enterprises will be required to adopt the national standards before new local standards are implemented.
