On June 7th, 2021, the Han River Basin Environmental Office under the Ministry of Environment (MoE) issued a notice [1] to announce the initiation of the 4th statistical survey of chemical substances in 38769 enterprises in its jurisdiction. The statistical survey was conducted for the first time in 2015. According to the Chemical Control Act (CCA), MoE shall conduct statistical surveys on the current status of handling related to the handling of chemical substances, handling facilities, etc. every two years, aiming to investigate the types of chemical substances in South Korea, as well as their manufacturing, import and export, and use conditions, to reduce chemical accidents, strengthen accident response capabilities, and ensure that companies are in compliance with international conventions (Related provisions are specified in Chapter 2, Article 9-12 in CCA).
Enterprises that meet any of the following 3 conditions are the survey target enterprises and shall respond to the statistical survey of chemical substances:
Enterprises that have applied for installation of air/wastewater discharge facilities;
Enterprises that actually manufacture, import, export, use, and store chemical substances and the handling amount of related chemical substances exceed the exemption amount (the exemption amount for hazardous substances is 0.1 ton/year and for general substances is 1 ton/year);
Type C, D, and E enterprises (There is no exemption amount for such enterprises, they must respond to the statistical survey).
*Type C Enterprises: Manufacturers;
*Type D Enterprises: Power, gas, etc. supply enterprises;
*Type E Enterprises: Water supply enterprises, and sewer and waste disposal enterprises.
It shall be noted that an enterprise that is not a survey target enterprise still has to submit an application to the authority to obtain an exemption approval.
The deadline for submitting statistical surveys varies according to the type of enterprise:
For a Type C, D, or E enterprise, who is with an air pollutant or wastewater discharge facility, the deadline is June 30th, 2021;
For a Type C, D, or E enterprise that Paragraph (1) is not applicable to, the deadline is July 31st, 2021;
For other types of enterprises, the deadline is August 31st, 2021.
Enterprises that fail to report or make false reports can be punished with a one-month suspension of business and a fine of 10 million KRW.
