South Korea Updates Quantity Limits for Hazardous Chemicals that Require Submitting Chemical Accident Prevention Management Plan (Updated)

Updated: On November 5, 2021, the revision to the Regulation on the Stipulated Quantities for Toxic Substances, Restricted Substances, Prohibited Chemical Substances, and Substances subject to Authorizationevision was approved by MOE Announcement No.2021-220. Compared to the draft amendments (see below), there are no changes made in the final revised version. The amendments took effect immediately. In addition, from November 8, the chemical accident prevention management plans can be submitted online through the platform: icis.me.go.kr/cdms 

Published on October 8, 2021, by MoE Notice No. 2021-676, South Korea’s Ministry of Environment (MoE) consulted on the amendments to the Regulation on the Stipulated Quantities for Toxic Substances, Restricted Substances, Prohibited Chemical Substances, and Substances subject to Authorization (hereafter referred to as the Regulation). Public comments are welcome before October 28, 2021. 

The amendments include:

  • Adding 23 newly designated toxic substances (NIER Given No. 2021-1-1057~2021-1-1079) in Annex 1 of the Regulation, with the upper and lower handling quantities;

  • Updating CAS Number of two toxic substances previously designated

The Regulation is formulated to facilitate the implementation of chemical accident prevention management plans mandated under the Chemicals Control Act, which is a mandatory requirement for handling hazardous chemicals in South Korea from April 1, 2021. (See ChemLinked news). Basically, for a hazardous chemical, exceeding the upper handling limit requires submitting the Grade 1 chemical accident prevention management plan, while the Grade 2 chemical accident prevention management plan can apply if it only exceeds the lower handling limit.
