On April 18, 2022, South Korea’s National Institute of Environmental Research (NIER) issued two notices (NIER Announcement No.2022-158 and NIER Announcement No.2022-159), seeking public comments on the amendments to the Toxic Chemical Substances List (TCSL) and the GHS Classification List. The consultations will end on May 9, 2022.
Main Points of NIER Announcement No.2022-158
Designating 10 substances as toxic substances (NIER Given No. 2022-1-1099 ~ 2022-1-1109), which were registered and found toxic after the hazard evaluation under K-REACH; and
Updating chemical names of 35 toxic substances that were previously designated.
The transitional measures for the 10 toxic substances are proposed as below:
Manufacturers or Importers of these newly added toxic chemicals shall submit a "Written Confirmation of Details for Chemical Product" before January 1, 2023 in accordance with Article 9 of Chemical Control Act (CCA).
Handling of these newly added toxic chemicals is subject to labeling before January 1, 2023 in accordance with Article 16 of CCA.
Importers should conduct importation notification before January 1, 2023 according to Article 20 of CCA.
All enterprises handling these newly added toxic chemicals or having installed and operated handling facilities for these toxic chemicals shall prepare the chemical accident management plan1 before July 1, 2024 according to Article 23 of CCA.
Manufacture, sell, storage, transport or use of these newly added toxic chemicals is subject to business licensing in accordance with Article 28 of CCA. In addition, stakeholders should comply with the requirements in terms of facilities, equipment and technical personnel qualifications, etc. before July 1, 2024 to obtain their license.
All enterprises handling these newly added toxic chemicals or having installed and operated handling facilities for these toxic chemicals shall comply with the standards specified in Annex 1 of CCA Enforcement Rules before July 1, 2023 and shall comply with the standards specified in Annex 5 of CCA Enforcement Rules before July 1, 2026.
In addition, the classification and labeling information of some chemical substances will be updated according to the NIER Announcement No.2022-159. Proposed updates include:
Adding the 10 substances (NIER Given No. 2022-1-1099 ~ 2022-1-1109) with corresponding classification information, pictogram, signal words, hazard statements, M factors and UN No., etc., which were registered and proposed to be designated as toxic substances after hazard evaluation under K-REACH; and
Updating the name or classification information of 63 toxic substances, 4 types of restricted substances (NIER Given No. 06-5-4, 06-5-5, 06-5-6, 06-5-10) and 5 accident precaution substances (NIER Given No. 1, 35, 43, 47, 52) that were previously designated.
