Taiwan Lists 15 Substances as Chemicals of Concern (Updated on January 12, 2023)

The listing of 15 substances as chemicals of concern will trigger further regulatory actions under Taiwan TCCSCA.

Updates: On January 12, 2023, Taiwan EPA listed these 15 chemical substances as concerned chemical substances. Their production, import, sale, use and storage are now subject to tightened regulations under Taiwan TCCSCA.

Online sales of these substances are prohibited immediately. However, transitional periods have been granted for complying with new requirements, including pre-approval prior to manufacture, import, sales, use or storage, handling quantity recording and reporting, accident prevention and emergency response, labelling and SDS requirements, etc. For example, existing handlers shall obtain the approval before February 1, 2024.

Taiwan EPA is consulting on designating 15 chemical substances as “chemical substances of concern”, including 2 new psychoactive substances, 5 chemicals of food safety concerns and 8 precursors for blasting explosives. The 14-day consultation period will end on September 22, 2022.

The chemical substances of concern are subject to regulation under the Toxic and Concerned Chemical Substances Control Act (TCCSCA). They will be designated and assigned to the tables attached to the Categories and Management of Handling for Concerned Chemical Substances Regulation (hereafter referred to as the Regulation) based on substance characteristics or public consumer issues of concern.

In addition, transitional measures have been proposed for these chemical substances in terms of pre-approval prior to manufacture, import, sales, use or storage, handling quantity recording and reporting, accident prevention and emergency response, labelling and SDS requirements, etc.
