Taiwan revises the regulation on hazardous chemicals posing public safety risks The range of flammable liquids is enlarged The scope of chemicals of high flash point is narrowed

On May 4th 2016, Taiwan Ministry of the Interior and Ministry of Economic Affairs jointly issued a gazette that revised the Standards on Hazardous Chemicals of Public Safety Risks and Flammable Gases of High Pressure and Safety Management Measures.

According to the revision notice, two previous requirements are deleted:

  • In Article 15 of the regulation, it was stipulated that electronic equipment should comply with the relative requirements of the in-house circuit rules. Now this requirement is deleted because this matter is regulated by the Electricity Act.

  • In Article 75, the requirement to examine the valves of the containers for liquefied petroleum gases is deleted because now valves are all required to be replaced with new ones during the examination.

Some of the articles are revised:

  • In Article 3, the 4th classification of the hazardous chemicals of public safety risks was defined as flammable liquid. Now the combustible liquid is added to the definition, enlarging the range of chemicals that are subject to the regulation greatly. The difference of the flammable liquids and combustibles liquid is:

    • Flammable liquid: Liquid whose flash point is no higher than 93℃

    • Combustible liquid: Liquid whose flash point is between 93℃ and 250℃

  • In Article 8, the definition of “chemicals of high flash points” is changed from chemicals with flash points above 130℃ to chemicals with flash points above 100℃. The new definition aligns with that in Japan and US. Different from the revision in Article 3, this change actually narrows the scope of the definition.

  • Some other requirements on the stack height on out-house storage, the storage of liquefied petroleum gases, the examination of containers for liquefied petroleum gases, the distance between containers or tanks, etc. are also revised.
