Vietnam Amends National Regulation on Safety for Hazardous Chemicals

The revision includes new provisions on storage and transport of hazardous chemicals.

On October 10, 2024, Vietnam's Ministry of Industry and Trade (MOIT) released the Circular No. 19/2024/TT-BCT, which amends the National Technical Regulations on Safety in Production, Trading, Use, Storage and Transportation of Dangerous Chemicals (QCVN 05A:2020/BCT)

This Amendment comes into force from April 15, 2025, providing one-year transitional period for any factory and warehouse containing hazardous chemicals put into operation to meet the requirements set out in the Amendment by April 15, 2026. 

Background

Since the issuance of Circular No.48/2020/TT-BCT promulgating QCVN 05A: 2020/BCT on December 21, 2020, the management of chemical activities in general has increasingly improved. However, some provisions have proved inappropriate when applied in practice. 

On March 22, 2024, MOIT consulted on a draft amendment to the National Technical Regulation and submitted it to the Vietnam Chemicals Agency for approval. 

Storage of hazardous chemicals

All factories and warehouses containing liquid hazardous chemicals, corrosive chemicals, or toxic chemicals in liquid form must now be equipped with a collection system to prevent chemical spills and escapes to the environment. 

In addition, the storage of toxic chemicals in liquid and gas form must also be installed with leak and spill warning devices. Surveillance cameras shall be installed for solid poisons.

The revision also introduces the requirement for personal protective equipment (PPE) in the event of a fire or explosion incident. 

Transport of hazardous chemicals

The reference regulatory document for transport of hazardous chemicals is now updated to align with Decree No.34/2024/ND-CP On List Of Dangerous Goods, Transport Of Dangerous Goods By Road Motor Vehicles And Inland Watercraft. The placards in Annex A are also updated to align with the latest international convention.
