Vietnam Considers Amending National Regulation on Safety for Hazardous Chemicals

Several provisions of QCVN 05A: 2020/BCT are not consistent with the reality over 2.5 years of implementation.

On August 8, 2023, Vietnam's Ministry of Industry and Trade issued a notification to consult on the implementation of National Technical Regulations on Safety in Production, Trading, Use, Storage and Transportation of Dangerous Chemicals (QCVN 05A: 2020/BCT). Stakeholders are welcome to send opinions to the Department of Chemicals.

Since the issuance of Circular No.48/2020/TT-BCT promulgating QCVN 05A: 2020/BCT on December 21, 2020, the management of chemical activities in general have increasingly improved. However, some provisions have proved inappropriate when applied in practice.

Recently, several Departments of Industry and Trade have proposed to the Department of Chemicals to clarify and amend a number of points that are not consistent with the provisions of QCVN 05A: 2020/BCT. For more information, the department conduct a public survey to assess and pinpoint issues in preparation for a forthcoming amendment.

According to the Circular, the National Regulation took effect on January 1, 2021, with a 18-months transitional period. It applies to all organizations and individuals engaged in production, trade, use, storage and transportation of industrial hazardous chemicals. The key requirements are outlined as follows:

  • Documents, boards and signs

  • Work exposure to hazardous chemicals

  • Chemical incident response and environmental protection

  • Chemical facilities and storage

  • Equipment for production, storage, transport and use of hazardous chemicals

  • Containers and goods labels

  • Production, trade, use, storage and transportation of flammable and explosive/corrosive/toxic chemicals

  • Outdoor chemical containers

  • Transportation and loading/unloading of hazardous chemicals

In addition, the GHS pictograms (GHS01~GHS09) and their associated divisions are indicated in Appendix A. Appendix B contains a list of incompatible chemicals by GHS pictograms and their associated classes and divisions.
