Taiwan TCSCA: Chemical Substance Supplementation Ends 31 Mar 2015

When the revised Toxic Chemical substances Control Act (TCSCA) comes into force, chemicals manufactured or imported to the Taiwanese market before 11 Dec 2014 will be eligible for inclusion into The Taiwan Existing Chemical Substance Inventory (Taiwan ECSI) as existing chemical substances. Companies must provide proof of these substances previous manufacture or import before 31 Mar 2015, as specified in the Article 16 of the Regulation on Registration of New and Existing Chemical Substances under TCSCA.

The SSECN was finalized at the end of July of this year (2014). All chemicals handled in Taiwan between January 1st, 1993 and December 31st, 2011 have been appended to the ECSI. This new supplementation program is mainly for chemicals manufactured or imported after the 31st of December 2011.

If the substance is failed to be included into the ECSI under TCSCA, it will be regarded as new chemical substance. A low-volume registration should be applied for immediately to avail of a one-year grace period. If found manufacturing or importing without a low-volume registration certificate, a fine of up to NT$2 million shall be imposed. In addition, manufacturers or importers will be ordered to suspend work, suspend business or return exports if rectification is not made within a given time period on 2 occasions.
