On Dec 15 2017, Thailand Department of Industrial Works (DIW) under the Ministry of Industry (MOI) published an amendment to the List of Hazardous Chemicals under the Hazardous Substances Control Act.
The amendment focuses only on Annex 5, which contains the hazardous chemicals regulated by DIW. 22 chemical substances are added to Annex 5.1 with CAS numbers and use conditions. One chemical group (mercury compounds) is added to Annex 5.4. Mercury compounds have also been listed in other annexes of the List of Hazardous Chemicals before and are regulated by other authorities. For example, the mercury compounds used in the household products are regulated by FDA. This amendment means that DIW is now another authority tasked with regulating mercury compounds and is responsible for use of mercury compounds only in laboratories.
The amendment will be officially published in Thailand’s Royal Gazette and will take effect the day after publication. All the chemicals added are classified as Type 3 chemicals and subject to compliance duties such as registration, notification, and application for licenses. The manufacturer, importer, exporter, and holder of the added chemicals should apply for license of Type 3 chemicals within 30 days after the amendment becomes effective.
