Thailand Amends List of Hazardous Substances

On Dec 14th 2016, Thailand Ministry of Industry (MOI) issued a notice (B.E. 2559), making some changes to the List of Hazardous Substances under the Hazardous Substances Control Act (HSCA). With these changes made, the current List of Hazardous Substances has already been revised 2 times and is in its 3rd edition. (Click here to see the changes made in 2015 and 2nd edition of the List)

The detailed changes are as follows (9 substances were added and 4 were modified):

  • The use conditions of two substances in Annex 4.1 (No. 3 and No. 157) were modified.

  • Formaldehyde methanal was added into Annex 4.1.

  • The use condition of “products used for text correction/removal or as solvent for chemicals used for text correction/removal or dry cleaning of fabric or other textile products” in Annex 4.3 was modified.

  • 8 substances were added into Annex 5.1 which is regulated by Department of Industrial Works (DIW).

  • The hazard classification of hydrofluorocarbons in Annex 5.4 was changed from 3 to 1.

The 1st stage of nomination for the National Chemical Inventory of Thailand ended on Dec 31st 2016. However, the Annex 5.6 notification is still in process. Enterprises should define their chemical substances and if substances are listed in the List of Hazardous Substances, then enterprises should undertake notification, registration, or application for permit according to the hazard classification of the substances. If they are not in the list but do meet Annex 5.6 criteria then enterprises should do the Annex 5.6 notification.
