On Dec 4th, 2018, Thailand Hazardous Substances Management Division under the Department of Industrial Works (DIW) opened the draft revisions to the Hazardous Substances Act to public consultation. The consultation period will end on Dec 14th, 2018.
The Hazardous Substances Management Division admitted in the notification that since the Hazardous Substances Act has been implemented for so many years, some of the articles are now outdated and have failed to keep pace with technical developments in the chemical industry and now fail to effectively regulate chemical hazards and risks. So the Division made some amendments to the Act and tried to improve their management on the hazardous chemicals circulating in Thailand. Some of the main changes in the draft include:
The personnel structure of the Hazardous Substance Committee in Section 6 is adjusted. The duties of the Committee are increased. For example, the Committee is now required to submit a report on the activities of hazardous substances in Thailand to the Cabinet every year.
The scope of prohibited activities of category 4 substances is expanded. The prohibition of disposal of category 4 substances is added to Section 18.
The validity period of the hazardous substance registration certificate in Section 36 is extended from 6 years to 10 years.
The hazardous substances that are used for testing, analysis, research and development are added into the scope of exemption in Section 44.
Some other amendments include the newly added requirements on the advertisements of hazardous substances, the increased and further specified penalties on the violations to the Act and some revisions and supplements to certain definitions, etc.
