Thailand Implements GHS for Hazardous Substances Used in Fisheries

Thailand implemented GHS Rev.3 for hazardous substances used in fisheries.

On November 30, 2021, Thailand’s Ministry of Agriculture and Cooperatives issued in the Government Gazette the Notification of the Ministry of Agriculture and Cooperatives Re: Hazard Classification and Communication System of Hazardous Substances Responsible for the Department of Fisheries B.E. 2564 (2021) (hereinafter referred to as the Notification), according to the third paragraph of Article 5 the Hazardous Substance Act B.E. 2535 (1992), and Article 20 (1) of the Hazardous Substance Act B.E. 2535 (1992) that has been amended by the Hazardous Substance Act (No.4) B.E. 2562 (2019). It stipulates that the hazardous substances (both single substance and mixture) used in fisheries shall comply with Globally Humorized System of Classification and Labelling of Chemicals (the third revised edition of UN GHS, 2009). It took effect immediately.

As clarified in the Notification, manufacturers or importers of hazardous substances used in fisheries shall abide by the GHS requirements specified in the Notification of Ministry of Industry Re: Hazard Classification and Communication System of Hazardous Substances B.E. 2555 (2012), in short as Notification of MOI B.E. 2555 (2012), including:

  • Identify hazards, including 16 physical hazards, 10 health hazards, and 2 environmental hazards;

  • Prepare a label; and

  • Prepare a safety data sheet (SDS)

Notably, a one-year grace period has been granted for a single substance, as well as a five-year grace period for a mixture. That is to say, a manufacture or importer of certain hazardous substances shall fulfill the GHS-related obligations mentioned above before December 1, 2022 for a single substance and before December 1, 2026 for a mixture.

For exporting of hazardous substances, hazard classification, labeling and a safety data sheet as per the Notification of MOI B.E. 2555 (2012) are required, except there are other specific requirements from the partner country.
