On March 31, 2024, Vietnam Ministry of Transport (MoT) released a new Decree on the transport of dangerous goods, which is Decree No. 34/2024/ND-CP On List Of Dangerous Goods, Transport Of Dangerous Goods By Road Motor Vehicles And Inland Watercraft. It came into effect on May 15, 2024 and replaced the Decree 42/2020/ND-CP.
The new TDG Decree was formulated to suit the management of ministries, sectors and localities and create more favorable conditions for transport units. This was in response to difficulties in the assignment of responsibilities and overlapping regulations over the process of practicing and implementing the regulation.
It inherits the list of 2921 dangerous goods with corresponding UN numbers, hazard signs, and hazard identification numbers (Annex I). The detailed requirements for hazard identification numbers (Annex II), hazard placards and hazard signs (Annex III) are unchanged.
As compared with the Decree 42/2020/ND-CP, the major revisions focus on:
Re-assignment of ministerial responsibilities for issuing dangerous goods license. For example, the Ministry of National Defense is added as the regulating authority for issuing dangerous goods transport license under its jurisdictions.
Streamline application procedures for dangerous goods transport license. For example, the required application documents for auto transport business license, registration receipt, inspection record are removed.
Specify minimum packaging and container requirement.
Introduce provisions on dangerous goods training. The consignors or carriers should organize dangerous goods training for each class and division of dangerous goods. The training conent shall include the name and nature of dangerous goods identification name, classification and labeling, dangerous goods safety regulations, safety risks during storage, loading, unloading, and transportation, incident response procudures, etc. They also need to furnish dangerous goods training program for the grant of a license to transport dangerous goods.
Dangerous goods license must bear a QR code provided by the licensing authority.
