Taiwan Chemical Commodity Importation Pre-Confirmation — Self-Declaration Border Control System Introduced

A voluntary pre-confirmation of chemical commodities on the IT platform of Chemical Commodity Importation Pre-Confirmation (CCIP) prior to importation was recently introduced in Taiwan. Stakeholders are encouraged to declare and confirm if there are any chemical substances subject to new and existing chemical registration according to Article 7-1 of Toxic Chemical Substances Control Act (TCSCA) and the Regulation of New and Existing Chemical Substances. Pre-confirmation on the CCIP IT platform (which will serve as a basis for post-market inspection) is administrated by Taiwan EPA and local environmental protection departments to support a better implementation of Taiwan’s chemical registration scheme.

Applicable scope

If any chemical substances contained in the imported commodity is subject to Taiwan’s new and existing chemical registration, the commodity is subject to pre-confirmation on the CCIP IT platform.

User eligibility

The CCIP IT platform is accessible to all relevant stakeholders.

  • 1. Taiwanese importer (namely registrant for Taiwan new and existing chemical substances)

  • 2. Third party representative (TPR)

  • 3. Non-Taiwanese companies (namely non-Taiwanese manufacturer or producer could complete the pre-confirmation by themselves)

  • 4. Other eligible entity

Data requirements

1. Importer information

Since the registration obligations are imposed on Taiwanese importers for importation activities. This information, especially the company name, address (in traditional Chinese only), and unified business No. should be identical to the information in registration dossier, and the taxpayer information specified in Import Declaration. The authority may hold on-site inspection according to information provided by the importer.

2. Goods information

  • C.C.C Code and CD: Basic format is 11 digits which should be consistent with the information supplied in the Import Declaration. In Taiwan, the C.C.C Code is the first 10 digits, of which the first 8 digit numbers are known as Tariff No. and the last 2 are Statistic Code. The 11th digit is a checking digit (CD). All traders are required to fill in all the 11 digits for their products when applying for customs clearance.

  • Goods name:  in accordance with the "Description of Goods(28)" on the Import Declaration

3. Information of chemical substances contained in goods

New and existing chemical substances subject to registration and those exempt from registration should be reported in this part. However, for new and existing chemical substances subject to registration, CAS No., chemical name or percentage of the substance contained in the goods (w/w, content range acceptable) are not mandatorily required. Only the registration No. is essential. For those exempt from registration, one of the exemption eligibility criteria listed below should be met:

  • Eligible for exemption as referred to the Article 4 of Regulation of New and Existing Chemical Substances Registration

  • Verified as Polymer of Low Concerns and the annual volume is less than 1 ton.

  • Used for Scientific Research and Development and the annual volume is less than 1 ton.

  • Existing chemical substances in quantity of below 0.1t/y

  • Others

Receipt of Chemical Commodity Importation Pre-confirmation will be issued after the completeness of self-confirmation on CCIP IT platform.

It should be noted that one-time pre-confirmation is sufficient for goods of the same composition. However, if the contained substance has a registration validity period, a new pre-confirmation should be made after an extension is applied. Below are two applicable situations:

  • A one-year grace period was granted for new chemical substance manufactured/ imported before 31 Dec 2015 with the submission of materials required for low-quantity registration. When the grace period expires, the new chemical substance requires a new registration accordingly and thus a new registration No. will be issued. The information should be updated on the CCIP IT platform.

  • Registration certificate of simplified registration and low-quantity registration is valid for two years, both can be extended when the validity expires.

Process of pre-confirmation

Post-market inspection

At present, the pre-confirmation is not mandatory. The commodities will not be shut out without pre-confirmation. However Taiwan EPA will use data cross-matching (data obtained in CCIP IT platform and obtained from Customs) to impose post-market inspection, with priority inspection of inorganic & organic chemicals (corresponding Chapter 28 & 29 of the C.C.C. Code) without pre-confirmation. Therefore we advise stakeholders to voluntarily report information of imported chemical commodity on the CCIP IT platform. Punishments for violations of registration requirements uncovered during on-site inspection will be apportioned with reference to Article 35-1 of Taiwan TCSCA.

It is also suggested to keep all relevant documents on record for future reference during inspection, e.g., SDS, printout of Taiwan Chemical Substance Inventory (TCSI) on CSNN website, approved document for R&D use and approved document for PLC use, etc.
