Vietnam: Latest Report on the Supplementation of NCI and the Draft of New Substance Act

By February 24th, the draft National Chemical Inventory contains 48,857 chemical substances, while only 9,618 substances have been approved. The draft of the new substance act has completed, it is expected to be published in the second quarter of 2021 and finally enter into effect by this year.

India REACH: Fifth Draft of the Chemicals Management and Safety Rules Released

India released the fifth draft of the Chemicals (Management and Safety) Rules (known as “India REACH”) on August 24, 2020. This fifth draft is believed to be the final draft, despite the fourth draft issued in March 2020 was claimed as the final draft. As planned, it will be notified to the WTO for a 60-day consultation and come into force early next year.

New Polymer Registration under China MEE Order No.12

Polymer registration is always of crucial concern for the chemical industry. They are generally regarded as representing a low safety concern and can benefit from exemption or reduced registration requirements under some circumstances. New polymers are assigned special provisions in the Measures for the Environmental Management Registration of New Chemical Substances (MEE Order No.12) which is set to take effect on January 1st next year and its draft Guidance on Environmental Management Registration of New Chemical Substances (hereafter referred to as the draft Guidance). This article provides details concerning special rules and related requirements for polymers to help enterprises better cope with the polymer registration under MEE Order No.12.

According to Article 10 of the OSHA, the employers shall label, make inventories, and display safety data sheets (SDS) for hazardous chemicals, and adopt necessary hazard communication measures. And the manufacturers, importers, or suppliers, before providing the chemicals to business entities or self-employed workers, shall label them and provide SDSs. The detailed requirements for the manufacturers, importers, and suppliers to disclose the information of hazardous chemicals are stipulated in the Regulations for the Labeling and Hazard Communication of Hazardous Chemicals (hereinafter referred to “the Regulations”).

Understanding India’s Final Draft of Chemicals Management and Safety Rules

India’s Chemicals (Management & Safety) Rules have been drafted for years, and when implemented, the rules will have a great impact on stakeholders handling chemicals in the Indian market. The final draft was shared with 12 industry bodies on March 16, 2020, and comments have been received until March 31, 2020. There is no timeline for public consultation. As planned, it will be notified to the WTO this year and come into force on the date when it is published in the Official Gazette.
