An Enterprise in Beijing Punished for Failing to Update the Emergency Response Plan

Emergency response plans of enterprises must be revised in time according to GB/T 29639-2020.

On May 8th, 2021, Beijing Emergency Management Bureau published an announcement of administrative penalty result [1], in which a feed producer in Beijing was published for failing to update the emergency response plans in accordance with GB/T 29639-2020, which violated Article 36, Paragraph, 1Item 2 of the Administrative Measures on Emergency Response Plan for Work Place Accidents.

GB/T 29639-2020 Guidelines for enterprises to develop emergency response plan for work place accidents was issued on September 29th, 2020 and entered into effect on April 1st, 2021, which provides enterprises with the preparation procedure and content system of emergency response plans for workplace accidents, as well as the main content and attachment information of the general emergency response plan, special emergency response plan, and on-site response plan (ChemLinked News [2]). Compared with its previous version published in 2013, the new Guidelines update the response plan preparation procedure, amend the content factors of the general emergency response plan and special emergency response plan, and specify the content of two new annexes. Therefore, it is necessary for enterprises to revise their emergency response plan to comply with the new content requirements.

The Article 36 of the Administrative Measures on Emergency Response Plan for Work Place Accidents specifies the conditions when the emergency response plan should be revised and archived in time. The administrative measures were amended in 2019 to adapt the Measures to the current online service system and requirements for the filing and drilling of key enterprises’ emergency plans were added meanwhile. In addition, high risk enterprises, such as the manufactory, business (with storage facilities, the same below), storage and transportation units of flammable or explosive substance or hazardous chemicals, should complete the filing of emergency response plans within 20 working days and practice drills once per half-year and the emergency management departments of the people's government at all levels should organize a drill every two years.
