China’s Ministry of Ecology and Environment (MEE) published the draft revision of the National Inventory of Hazardous Waste[1] for public comments on Sept 5, 2019. This consultation will end on Oct 10, 2019.
The National Inventory of Hazardous Waste was originally published in 2008 to regulate solid and semi-solid wastes that pose risks to the environment and human beings. The Ministry of Environmental Protection (Now MEE) published a draft version in 2014 which encompassed changes included to solve the problems inherent in implementation of National Inventory of Hazardous Waste (2008). In 2016, MEP passed a new version of the National Inventory of Hazardous Waste and this new version has been effective since Aug 1, 2016.
The draft revision of the National Inventory of Hazardous Waste published on Sept 5, 2019 will replace the National Inventory of Hazardous Waste (2016) when it takes effect. However, the date of entry into force for this draft revision is yet to be determined. And it is expected that the MEE will publish the latest version of the National Inventory of Hazardous Waste in 2021.
The National Inventory of Hazardous Waste (2016) had many problems revealed during implementation, for example, it didn’t have accurate definitions for classifications of some hazardous wastes and could not adequately meet the requirements stipulated by the hazardous waste business certificate. The 2016 version offered an exemption list, but the exemption scope required expansion.
Compared to the National Inventory of Hazardous Waste (2016), the latest draft revision published on Sept 5 includes the following changes:
The text content has changed from 9 articles into 7 articles. Article 6 and 8 of the 2016 version has been deleted and relevant terminologies in Article 7 of the 2016 version have been revised.
The National Inventory of Hazardous Waste has been updated with 7 hazardous wastes (code 261-184-11,336-107-17,321-031-48,900-050-49,900-051-49,900-052-49,900-053-49) being newly added into the inventory, another 7 hazardous wastes (code 272-002-02, 900-036-45,252-014-11,900-040-49,261-171-50,900-018-15,267-004-15)have been deleted and 15 hazardous wastes have been united into 7 hazardous wastes(code 272-003-02,275-005-02,900-402-06,252-002-11,252-008-11, 252-004-11,321-002-48). In addition, the hazardous descriptions of 38 hazardous wastes have been revised.
The exemption list has been updated. 13 hazardous wastes were newly added into the list. One of the hazardous wastes will be exempted from the whole process, 9 hazardous wastes will be exempted from the exploitation or disposal process and 3 hazardous waste will be exempted from the transportation process.
