China Requires Certificate Holders of New Chemical Substances to Submit Annual Reports

China SCC issued a notice to remind enterprise of the deadline for submission of annual reports of new chemical substances. Failure to submit the annual report is subject to a fine up to RMB 10,000.

China’s Solid Waste and Chemicals Management Center (SCC) issued a notice reminding simplified and regular notification certificate holders to submit annual reports for their production and import activities of new chemical substances in 2018. The online submission system will open on Jan 1st, 2019 and the submission is due by Feb 1st, 2019.

Before the deadline, certificate holders are allowed to revise or supplement the submitted annual report. Certificate holders failing to submit the annual report can be fined up to RMB 10,000.

45 previously notified new chemical substances were appended to the Inventory of Existing Chemical Substances (IECSC) in November of 2018 (CL news), of which 2 substances were notified under MEP Order 7 (Measures for the Environmental Management of New Chemical Substances) and the other 43 substances were notified under SEPA Order 17 (the precursor of MEP Order 7). For the 2 substances notified under MEP Order 7, although they are now regulated as existing chemical substances and have no tonnage limit anymore, annual reporting for 2018 production and import activities is still required. It should be noted that new chemical substances notified under the SEPA Order 17 do not need to submit the annual report.

In addition, with more applications for the modification of registration certificates approved, it should be noted that the annual report will require the information of the annual activities covered under both the original and the modified registration certificates.
