China to Exempt Household Products and Medical Supplies from Hazchem Operation Permission

China will revise the applicable scope of the Measures for the Administration of Hazchem Operation Permit to exempt household chemical products and medical devices that contain hazardous chemicals.

According to Measures for the Administration of Hazardous Chemicals Operation Permit1 (hereinafter referred to as the Measures), enterprises that are engaged in business operation (including storage) of hazardous chemicals in China shall obtain a permit for the business operation of hazardous chemicals (hereinafter referred to as the ‘Operation Permit’).

In practices, for individual operators, e.g., retail store owners, who handle small packages of household chemical products containing hazardous chemicals, e.g., paints, adhesives, medical alcohol, butane gas lighters in bottles, small gas stoves, etc., they don’t need to apply for the Operation Permit since they are not enterprises registered to the authority. Furthermore, whether enterprises handling medical equipment or sterilization supplies that contain hazardous chemicals shall apply for the Operation Permit or not, the requirement varies from region to region.

To address these issues, the Ministry of Emergency Management of People’s Republic of China (MEM) plans to revise the Measures to adjust its applicable scope. According to the official replies (see below screenshots) published on the MEM website in 2022, the proposed applicable scope will no longer cover hazardous chemicals that are used for household chemical products and medical devices.

The current applicable scope of the Measures:

  • Hazardous substances listed in the China Inventory of Hazardous Chemicals (2015)2

  • Other products falling under Entry No. 2828 of the Inventory, including synthetic resins containing flammable solvents, paints, auxiliary materials, coatings, etc. [closed cup flash point ≤ 60℃] (for mixtures)

  • Mixtures, of which the major compositions are listed in the Inventory, and the sum of their mass fractions or volume fractions is no less than 70% (unless it is determined not eligible for the hazardous chemical determination principles after hazard identification)

Once the revision is adopted, enterprises or individual operators that handle household chemical products (e.g., perfume, lighters), sterilization supplies (e.g., 84 disinfectant, 75% alcohol hand sanitizer, disinfectant gel) or medical supplies (e.g., Methyl 2-methylacrylate,stabilized, used as liquid for denture acrylic) do not need to apply for the Operation Permit under the Measures. However, currently the enterprises still need to follow the requirements of local department of emergency management.

However, whether these products can be exempt for Hazchem registration in the future is not clear. ChemLinked will keep close attention to the future updates. Please stay tuned.
