On Jun 5th, 2018, Chinese Ministry of Industry and Information Technology (MIIT) announced on its website the draft revisions to the Measures of Production License of Civil Explosives.
The revisions follow the State Council’s decision to delegate some power to the lower administrations. When the production of civil explosives were managed by the State Council, production enterprises needed to apply for the production license and then obtain a safety production stamp on the license. Now the management of civil explosives are regulated by the provincial authorities instead of the State Council. The production qualification has also been split into two separate licenses, the production license and the safety production license. To better support the modification of policies, MIIT carried out the draft revisions to the Measures. The main revisions include:
The principles of licensing the production of civil explosives are more flexible. The provincial authorities are allowed to adjust their decisions based on practical conditions.
The criteria that the enterprises must meet in order to apply for the license are further specified, including the production technique, production facilities, storage conditions, staff qualifications, etc.
The application of the license is divided into four types, namely the first-time application; the application for changing the products types, production capabilities, or production address; the application for extension of the license; and the application for changing enterprise information.
Now any large enterprise that has obtained the license is allowed to authorize its subsidiary companies to manufacture the civil explosives under certain conditions. So the subsidiary companies don’t have to apply for the license again.
The annual report system is established. The report should be submitted before May 31st every year.
Supervision during and after production is newly emphasized.
