EU Extends CLP Compliance Deadlines for New Labeling Rules to 2028

The new regulation amends the timelines previously set by Regulation (EU) 2024/2865, effectively pushing back the mandatory compliance deadline for new label formatting, advertising, distance sales, and updating labels to January 1, 2028.

On December 3, 2025, the European Union published Regulation (EU) 2025/2439 in the Official Journal, officially delaying the application dates for several key provisions of the Regulation (EU) 2024/2865 amending Regulation (EC) No 1272/2008 on classification, labelling and packaging of substances and mixtures. This regulation enters into force on December 23, 2025 (the twentieth day following its publication).

Regulatory Background

This decision stems from findings in the 2024 "Future of European Competitiveness" report (the Draghi report), which highlighted that complex regulations were creating excessive administrative burdens and limiting the competitiveness of Union undertakings.

Specifically, the Commission identified that the requirements introduced by Regulation (EU) 2024/2865 regarding label formatting and fuel station labelling were potentially impractical and costly without delivering proportional health or environmental benefits. Consequently, the EU institutions have opted to defer these obligations to allow time for further simplification of the rules and to give economic operators adequate time to prepare.

Scope of the Deferral

The primary impact of Regulation (EU) 2025/2439 is the postponement of the application date from previously earlier deadlines to January 1, 2028, for the following requirements:

  • Label Formatting: Strict new rules regarding minimum font sizes, line spacing, and the formatting of label elements (e.g., text must be black on a white background, specific distance between characters).

  • Distance Sales and Advertisements: Obligations to include hazard information (such as pictograms and signal words) in advertisements and distance sales offers for hazardous substances and mixtures.

  • Timelines for updating labels: Obligations to update labels without undue delay following a change in classification (6 months for more severe classifications/new hazards; 18 months for other changes).

  • Fuel Station Labelling: Requirements for labelling fuels supplied at filling stations, including provisions regarding pump labelling and the physical supply of labels for portable containers.

Transitional Provisions

Substances and mixtures may continue to be classified, labelled, and packaged in accordance with the existing rules applicable on December 9, 2024, until December 31, 2027.
