On April 27, 2023, Ministry of Environment, Forest and Climate Change (MOEFCC) announced to publish the Plastic Waste Management (Amendment) Rules, 2023 on the Gazette of India. The amendment came into force on the date of publication in the Gazette.
To properly address the scientific plastic waste management in India, MOEFCC promulgated the Plastic Waste Management Rules, 2016 on March 18, 2016 and amendments to it in 2018, 2021, and 2022. Compared with the latest Plastic Waste Management Second Amendment Rules, 2022, the following amendments have been made:
Protocols for compostable and biodegradable plastic materials
Transitional period for provisional certificate for biodegradable plastics is extended for one year. The provisional certificate shall be valid till June 30, 2024 with the condition that production or import of biodegradable plastics shall cease after the May 31, 2024.
Marking or labeling
For rigid plastic packaging, it is not required to print the name, registration number of the manufacturer and thickness in case of carry bag.
Registration of producer, recyclers and manufacturer
In the case of renewal of registration, producers are no longer required to make an application to the State Pollution Control Board (SPCB);
The granted registration shall be changed only on the request of Producers, Importers and Brand owners (PIBOs) under the existing Extended Producer Responsibility registration
The registration shall be valid for a period of one year, unless revoked, suspended or canceled and shall subsequently be granted for three years.
Schedule II. Guidelines on Extended Producer Responsibility (EPR) for Plastic Packaging
Amends the detailed requirement for EPR registration as follows: While registering, the entities shall have to provide PAN Number, GST Number, CIN Number in case of company, and the entities may provide Aadhar Number, and shall provide PAN Number of authorized person or representative and any other necessary information as required;
Specifies that the last date for filing of annual returns for PIBOs shall be October 31, 2023 for the financial year 2022-2023;
Specifies that the last date for filing of annual returns for plastic waste processors shall be July 31, 2023 for the financial year 2022-2023.
