On June 13, 2022, Indonesia’s Ministry of Trade (MoT) issued the Regulation No. 40 of 2022 (hereinafter referred to as the Revision), amending the Regulation of the Ministry of Trade No. 18 of 2021 on Goods Prohibited from Import and Export (MoT Reg 18/2021). The Revision took effect on June 14, 2022.
This Revision only concerns with Annex 2 of the MoT Reg 18/2021. It stipulates the HS Codes, product names and descriptions of goods prohibited from import. The categories of goods in Annex 2 are listed below:
Sugar
Rice
Ozone-depleting substances
Used bags, clothes, fabrics, etc.
Cooling machines using chlorofluorocarbon (CFC) and hydrochlorofluorocarbon 22 (HCFC-22)
Food and pharmaceutical raw materials
Hazardous and toxic substances (B3)
Hazardous and toxic waste (B3 waste)
Farm tools and other hand tools
Medical devices containing mercury
Through this revision, the number of prohibited items in Annex 2 changed from 149 to 167, with some items deleted, added or modified, e.g., adding Basmati rice, Malaysian rice, fungicides and insecticides in aerosol packs; revising HS Codes of cooling machines using CFC/HCFC-22; deleting granulated slag (slag sand) from the iron or steel manufacturing industry etc. However, there is no updates on categories of B3, B3 wastes and ozone-depleting substances.
The MoT Reg 18/2021 was issued on April 1, 2021 and went into effect on November 19, 2021, replacing the following three former regulations:
Regulation of the Minister of Trade No. 45 of 2019 on Goods Prohibited from Export and
Regulation of the Minister of Trade No. 12 of 2020 on Goods Prohibited from Import.
*Note: The Ministry of Industry and Trade was separated into the Ministry of Industry and the Ministry of Trade in 2004.
The MoT Reg 18/2021 consists of three parts:
The text (10 articles, including definitions, applicability of prohibition and sanction etc.),
Annex 1 (List of Goods Prohibited from Export), and
Annex 2 (List of Goods Prohibited from Import).
According to the domestic economic development and changes in international trade, Indonesia is expected to update the lists of prohibited goods in a regular basis.
