Japan Consults on Annual Reporting Exemptions for 133 Substances under CSCL

On January 7, 2022, Japanese Ministry of Economy, Trade and Industry (METI), Ministry of Health, Labor and Welfare (MHLW) and Ministry of Environment (MOE) consulted on adding 133 substances to the list of substances exempt from annual reporting under the Chemical Substances Control Law (CSCL). Comments are due by February 6, 2022, and the final list is expected to be released in late March, 2022. The list is generally updated on a yearly basis. As of March 31, 2021, there were 3,110 substances on the list.  

Under CSCL, manufacturers and importers of general chemical substances in volumes at 1 ton or more must submit annual reports to the METI, MHLW and MOE. While annual reports are not required for exempted substances, which are not classified as Class I or Class II specified chemical substances, or require hazard or risk assessment. 

The exempted substances are selected from the following three categories:

  • polymers of low concern that are confirmed through a safety testing scheme for high polymer compounds;

  • chemicals that already exist in large quantities in nature; and

  • chemicals that may be subject to marketing restrictions by other laws.
