On the 25th of Nov 2014 Korea’s MoE issued a notice concerning existing chemical substances subject to exemption from annual reporting. Two attachments listing the substances subject to exemptions were also issued. The period for public consultation will close by the 15th of Dec 2014.
K-REACH stipulates that manufacturers, importers or sellers should report annually to MoE the volume and use etc. information of (1) all new chemical substances regardless of tonnage and (2) existing chemical substances at or above 1 ton/year in the previous year. It should be noted that downstream users are exempted from annual reporting obligations.
According to Article 8 Paragraph 2 of K-Reach, exemptions from annual reporting apply to:
Chemical substances imported which are incorporated into machines
Chemical substances imported along with machines or devices for trial run
Chemical substances in products in solid form, performing certain functions and are not released during use
Others prescribed by the Article 7 of President Decree
In addition, MoE has also proposed to exempt annual reporting requirements for existing chemicals including,
Existing chemical substances with substantiated low hazard (Attachment 1, including 40 substances)
Existing chemical substances not designated as priority evaluation chemicals (PECs) according to Article 9 of K-REACH (Attachment 2)
Hydrates or hydrated ions, formed after the combination of existing chemical substances specified in Attachment 1 and 2 with water
The substance tonnage and usage information of the previous year (1 Jan-31 Dec) is required to be submitted by 30 Jun. The first annual report submission should be done by the 30th of Jun 2016. However, manufacturers, importers or sellers handling chemical substances that meet the exemption preconditions will be subject to far less compliance obligations.
