Malaysia Requires Annual Certification for Chemical Exported to Non-Party State under Stockholm Convention

Malaysia is implementing the requirement of annual certification for exporting chemicals to non-Party States pursuant to the Stockholm Convention.

The Malaysian Department of Environment (DOE), acting under the provisions of the Stockholm Convention, has issued a notice requiring an "Annual Certification" for the export of chemicals to countries not party to the Convention. This measure ensures compliance with global environmental and health safeguards, particularly in managing Persistent Organic Pollutants (POPs), as outlined in Article 3 of the Convention.

Key Requirements for Export Compliance

Under these rules, any non-Party state importer of chemicals listed in Annex A or Annex B must first get an "Annual Certification" from DOE. This certification will only be granted if it:

  • Clearly specifies the intended use of the chemical, and

  • Contains Malaysia’s formal commitment to protecting human health, the environment, and adherence to the Stockholm Convention’s provisions.

To obtain this certification, the importers must submit the following supporting documents to DOE prior to any importation application:

  • A Safety Data Sheet (SDS) and detailed descriptions of the chemical’s properties and intended use.

  • Plans for safe handling, storage, and transport of the chemical.

  • Environmentally sound disposal methods for unused or obsolete chemicals.

  • Monitoring mechanisms to track the chemical’s lifecycle and ensure compliance.

  • Worker safety measures and public awareness initiatives, where applicable.

Once the DOE approves the documentation, the certification will be issued to the importer. The importing entity must then forward the certification and supporting documents to the exporting country. The exporting Party must submit this certification to its National Authority at least 60 days before initiating the export process, ensuring alignment with international regulatory timelines.
