MEE Consults on Guidance of Post-issuance Management on Pollutant Emission Permit

To further promote the implementation of pollutant emission permit, MEE has released the Guidance of Post-issuance Management on Pollutant Emission Permit for public feedback.

At present, China has issued over 20,000 Pollutant Emission Permits in over 15 industries, such as thermal power industry and papermaking industry. Currently, follow-up management after the issuance of pollutant emission permits is inadequate primarily due to the fact there are no related regulations to serve as reference.

This Guidance outlines the follow-up requirements on the permit holders after the issuance of pollutant emission permit. It specifies that the permit holders are responsible for legal compliance.

The MEE, as is noted in the Guidance, will strengthen its supervision through the following ways:

  1. Urge the permit holders to self-check its pollutant emission and undertake timely rectification of any illegal emission. The inspection scope mainly includes basic information (such as production facilities, emission outlets, etc.) and self-monitoring (such as the reliability of the data, self-monitoring facilities, analysis methods, etc.)   

  2. The provincial or local officials should investigate whether the information on issued permits is correct.

  3. Within the validity period of a pollutant emission permit, MEE should inspect the pollutant emission account at least 1 time.  

  4. The officials should annually verify enterprise’s annual executive report and see whether it is consistent with the pollutant emission account and monitoring data. If any inconsistency is spotted, the permit holder should give reasons. If the permit holder fails to give reasons or provide raw data, he/she will be punished accordingly.

  5. Within the validity period of a pollutant emission permit, MEE should assess (at least once) information disclosure of pollutant emission permits and publicize the results.
