Russia Plans on National Regulation on Chemicals

The proposed national regulation could serve as an alternative solution to Eurasia REACH for Russia.

In May this year, Russia's Ministry of Industry and Trade published a draft governmental decree dedicated to the proposed national technical regulation on safety of chemicals. 

The move came as the implementation of TR EAEU 041/2017 (also known as Eurasia REACH) got stuck on the agreement of second-tier legislation. TR EAEU 041/2017 was supposed to enter into force on June 1, 2021 but was continuously delayed due to disagreements among EAEU member states. In light of these developments, Russia is planning on implementing its national technical regulation on chemicals.

The proposed regulation is very similar to the TR EAEU 041/2017, but there are a few significant changes that demand our attention.

According to the TR EAEU 041/2017, chemical products that contain restricted substances in concentrations exceeding the specified limits will be subject to permitting state registration. The proposed regulation contain the same provision but adjusted the name from "restricted substances" to "substances of concern". Notably, the new definition includes more hazard types and concentration limits as follows:
