South Korea Allows Non-disclosure of K-REACH Registration Number on MSDS Transferred to Downstream Users

South Korea’s Ministry of Environment (MoE) recently announced the amendments to K-REACH Enforcement Rules, which took effect on August 1, 2023. The amendments concern the provision of chemical information. For certain chemicals, enterprises can indicate whether they have been registered/notified under K-REACH on the MSDS instead of providing their registration/notification numbers.

Under K-REACH and its Enforcement Rules, registered or notified chemical substances and mixtures containing such substances should transmit required chemical information in the supply chain, including registration numbers or notification numbers, substance names, hazards and risk information, and safety use information, etc. According to the previous Article 36 of the K-REACH Enforcement Rules, for chemicals that have prepared MSDS under K-OSHA, their chemical information can be transmitted by submitting both the MSDS and chemical safe report (CSR). However, for target chemicals illustrated in the table above, the CSR can be omitted but their registration or notification numbers must be provided. As these numbers may reveal confidential business information (e.g., mixture composition information), the MoE has revised the K-REACH Enforcement Rules on July 19, 2023, allowing non-disclosure of registration/notification numbers.
