South Korea Designates 23 New Toxic Chemical Substances and Updates GHS Classification List

23 substances were newly listed as toxic chemical substances after hazard evaluation under K-REACH. Classification and labeling information has been updated for 8 previously published substances.

On September 13, 2021, 23 toxic chemical substances (Given No. 2021-1-1057~2021-1-1079) were officially listed into the Toxic Chemical Substances List (TCSL) by NIER Announcement No.2021-62[1], with corresponding classification information, pictograms, signal words, hazard statements, M factors and UN No. They were registered and found toxic after the hazard evaluation under K-REACH.

The transitional measures for the newly designated 23 toxic chemical substances are as below:

  • Manufacturers or Importers of these newly added toxic chemicals shall submit a "Written Confirmation of Details for Chemical Product" before July 1, 2022 in accordance with Article 9 of Chemical Control Act (CCA).

  • Handling of these newly added toxic chemicals is subject to labeling before July 1, 2022 in accordance with Article 16 of CCA.

  • Importers should conduct importation notification before July 1, 2022 according to Article 20 of CCA.

  • All enterprises handling these newly added toxic chemicals or having installed and operated handling facilities for these toxic chemicals shall prepare before January 1, 2024 according to Article 23 of CCA the chemical accident management plan.

  • Manufacture, sell, storage, transport or use of these newly added toxic chemicals is subject to business licensing in accordance with Article 28 of CCA. In addition, stakeholders should comply with the requirements in terms of facilities, equipment and technical personnel qualifications, etc. before January 1, 2024 to obtain their license.

  • All enterprises handling these newly added toxic chemicals or having installed and operated handling facilities for these toxic chemicals shall comply with the standards specified in Annex 1 of CCA Enforcement Rules before January 1, 2023 and shall comply with the standards specified in Annex 5 of CCA Enforcement Rules before January 1, 2026.

The NIER also revised some of the regulations on the classification and labeling of chemical substances by NIER Announcement No. 2021-63[2], which came into effect immediately. 

The name or classification information of 4 toxic substances (Given No. 2017-1-766, 2018-1-824, 2018-1-874, 2020-1-970) and 4 accident precaution chemicals (Given No. 13, 17, 19, 25) previously designated was updated. For example, in the column "2018-1-824", [Oleic acid compound with (Z)-N-octadec-9-enylpropane-1,3-diamine (2:1)] was amended as [Oleic acid compound with (Z)-N-octadec-9-enylpropane-1,3-diamine].
