Updates:
By two announcements issued on November 17, 2023, South Korea’s NIER adopted the proposed updates to the TCSL and the GHS Classification List. The updated TCSL will come into force three months after its publication. The amendments to GHS Classification List took effect immediately.
Notably, the proposed updates regarding one substance (CAS No. 16415-09-1) are duplicates. This substance is assigned to both "NIER Given No. 2023-1-1166" and "NIER Given No. 2023-1-1174". Now, the duplication (NIER Given No. 2023-1-1174) is removed. Therefore, a total of 55 substances are newly designated as toxic chemical substances (NIER Given No. 2023-1-1119 ~ 2023-1-1173).
Manufactures, importers and handlers, who have operated businesses involving the 55 new toxic substances and mixtures containing them before the effective date, shall complete relevant obligations under the Chemical Control Act (K-CCA) within the deadlines specified. More specifically,
By July 1, 2024
Manufactures or importers shall submit a ‘Written Confirmation of Verification on Chemical Products’ as per Article 9 of K-CCA.
Handlers shall complete updating the labels of these toxic substances as per Article 16 of K-CCA.
Importers shall submit importation notification as per Article 20 of K-CCA.
By January 1, 2025
Handlers shall meet the criteria for handling toxic substances as per Article 13 of K-CCA and Annex 1 of K-CCA Enforcement Rules.
By January 1, 2026
Enterprises who install and operate relevant handling facilities shall prepare the chemical accident management plan as per Article 23 of K-CCA.
Handlers shall obtain the corresponding business license as per Article 28 of K-CCA.
By January, 2028
Enterprises which install and operate relevant handling facilities shall meet the standards for the establishment and management of such handling facilities as per Article 24 of K-CCA and Annex 5 of K-CCA Enforcement Rules.

South Korea’s National Institute of Environmental Research (NIER) is currently consulting on the amendments to the Toxic Chemical Substances List (TCSL) and the GHS Classification List. Comments are welcome before October 23, 2023. Once adopted, the proposed updates to the TCSL are expected to be in force three months after official publication, while the proposed updates to the GHS Classification List will be made effective immediately upon official publication.

Toxic Chemical Substances List
To designate 56 substances as toxic substances (NIER Given No. 2023-1-1119 ~ 2023-1-1174), which were registered and found toxic after hazard evaluation under K-REACH.
To assign CAS No. 2064323-02-8 to one toxic substance (NIER Given No. 2017-1-758) that was previously designated.
Transitional measures regarding import notification, licensing requirements labeling requirements, etc. will be provided for the control of these newly designated toxic substances under K-CCA. Details can be accessed in NIER Notice No. 2023-459.
GHS Classification List
To add corresponding classification information, pictogram, signal words, hazard statements, M factors and UN No., etc. of 56 substances (NIER Given No. 2023-1-1119 ~ 2023-1-1174), which were registered and proposed to be designated as toxic substances after hazard evaluation under K-REACH.
To update classification information of 15 toxic substances, 2 restricted substances (NIER Given No. 06-5-8 and 06-5-10), and 6 accident precaution substances (NIER Given No. 36, 51, 55, 90, 92 and 96) that were previously designated.
Draft updates to the GHS Classification List can be accessed in NIER Notice No. 2023-460. The last updates to these two lists were made on 1 August 2023 (CL news).
