On April 29, 2022, the South Korean Ministry of Environment (MoE) issued the MoE Announcement No.2022-2481 to announce the draft Regulation for Labeling and Advertising of Household Chemical Products (hereinafter referred to as the Regulation). Public comments are welcome before June 7, 2022.
The Regulation was drafted in accordance with the requirements prescribed in the Act on Safety Management of Household Chemical Products and Biocides (K-BPR) and its enforcement rules (K-BPR Enforcement Rules) (CL news), to tighten rules for the use of wording in the labeling and advertising of household chemical products subject to safety confirmation and biocidal products under K-BPR. Manufactures, importers, and sellers of such products shall comply with the Regulation.
The Regulation will prohibit the use of wording in the following situations:
It implies a product is non-toxic (e.g., Non-toxic, Toxic zero, pure);
It implies a product has no negative impact on the environment or nature (e.g., natural, green, eco-friendly), excluding phrases specifically indicating and advertising the name and content of substances derived from nature;
It may lead to excessive use of the product or induce incorrect use of the product by implying that there is no harm to the product (e.g., no effect on human body, no hazardous substances, safe for children); and
It implies a product has no negative impact on humans or animals (e.g., well-being, skin loving).
In addition, South Korea notified WTO of the Regulation on April 28, 2022 (Notification G/TBT/N/KOR/10692). According to the notification, the Regulation is expected to come into force in August 2023.
The MoE will review the appropriateness of the Regulation and make improvements every three years counting from July 1, 2022.
