Taiwan Issues 572 Priority Management Chemicals under OSHA

Taiwan’s Occupational Safety and Health Authority under MoL issued in Dec 2018 a list of 572 substances subject to Phase 2 management of “priority management chemicals”, which will come into force on 1 Apr 2019.

The list contains:

  • 90 chemical substances of CMR, Category 1, and

  • 482 chemical substances possessing physical hazards or health hazards (if exceeding corresponding maximum operation amount, which relates to the toxicity)

This is the second batch of priority management chemical substances designated according to the Regulation of Priority Chemical Substances Designation and Handling Management under OSHA regulation. It requires manufacturers, importers, suppliers, or employers to report relevant handling information of priority management chemicals to the MoL, including handler information, substance identity, quantity, use, exposure scenarios, etc.

The information should be filed using the offline preparation tool and submitted through the online platform within the permitted period based on the number of workers. Namely for this batch of substances, the corresponding implementation deadlines are:

  • Implementation: 1 Apr 2019

  • Number of workers ≥100: handling information shall be reported within 6 months due by 30 Sep 2019

  • Number of workers is <100: handling information shall be reported within 18 months due by 30 Sep 2020

Handlers who do not submit the report of priority management chemicals or falsely report shall fine in excess of NT$ 30,000 but not exceeding NT$ 300,000.
