On 26 Sep 2017 Taiwan Environmental Protection Administration (EPA) announced 13 substances as Class 4 toxic chemical substances. The recent occurrence of food safety incidents involving the illegal use of these chemical substances is the main driver behind the strengthened control.
Corresponding changes were made to the “Guidelines on Regulated Toxic Chemical Substances and the Management of Their Handling”. The summary of amendments to the Guidelines is as follows:
1. Adding Paragraph 15: When handling malachite green, maleic acid, maleic anhydride, dulcin, potassium bromate, dimethyl fumarate, benzyl violet 4B, metanil yellow, rhodamine B, butter yellow, sodium F, melamine, and coumarin (13 substances), apart from markings in accordance with the "Toxic Chemical Substances Labeling and Materials Safety Data Sheets Regulations" and other relevant regulations, the followings are required:
(1) "Not for use in foods" must be marked on container or outer packaging,
(2) The labeling area shall not be less than 35% of the area of the container or the outer packing area,
(3) The color of the words on label should be in contrast with the background color
2. Revision of Paragraph 1 Table 1:
(1) The 13 substances are designated as Class 4 toxic chemical substances with control concentration standards specified as 1% or more.
(2) The Chinese substance name for chromium carbonyl has been changed from”六羰化鉻” to “六羰鉻” and the control concentration standard has been amended to “chromium concentration 1% or more”.
3. Revision of Paragraph 4 Table 4: A table of improvement deadlines for the 13 substances has been provided, including:
(1) The recording and regular notification of toxic chemicals handling and release quantity shall start on 15 Feb 2018.
(2) The relevant marks concerning the containers, packages, workplace and facilities and the SDS should also be updated accordingly before 15 Jul 2018.
(3) Application for approval of manufacture, import and sale, use, storage and export should be accomplished before 15 Jan 2019.
(4) Other issues that haven’t been listed on this table should be complied with according to relevant regulations starting 15 Feb 2018
