Thailand’s existing chemical nomination deadline is fast approaching. Only a single month remains for industry to have their nominated chemicals included in Thailand’s 1st version of the existing chemicals inventory. A large number of companies are in the process of making their notifications. A major concern of many international manufacturers and suppliers is protection of their confidential business information (CBI), given that notifications must be made by domestic importers or manufacturers.
Regarding this issue Thailand’s Department of Industrial Works (DIW) has clarified that manufacturers and suppliers outside of Thailand can nominate their chemicals without disclosing composition information to their importers in Thailand. ChemLinked would like to share the practical steps involved in this process.
The designated importer in Thailand must log into DIW’s website for Annex 5.6 notification at: http://haz3.diw.go.th/hazvk and create an account:
Select “consultation toolbar” as shown in the picture and fill in the asked information. The required information is basically the information on the SDS. 100% composition information or CAS numbers are not required.

After filling in the information, the importer should print out the “consultation letter”, sign if off and write “ผู้ผลิตจะส่งองค์ประกอบสินค้าที่เป็นความลับทางการค้า ให้โดยตรงทาง e-mail” on it, which means “the manufacturer will provide CBI through email”.
The importer could go to DIW’s office and submit the consultation letter and SDS. The importer should also inform the DIW official that this is a CBI case and receive a submission number and submission date.
The importer gives the submission number and date to the manufacturer. The manufacturer can provide his CBI to DIW via email: [email protected], including 100% composition with CAS numbers, chemicals names and exact percentage, the manufacturer’s name and country. Remember, the submission number and date should be referred in the email’s subject.
The importer must wait for DIW’s response. DIW will give him a CBI consultation number after reviewing the materials.
At last, the importer can do the regular Annex 5.6 notification for the chemicals with this CBI consultation number. The blank shown in the picture is where the importer should fill the CBI consultation number.

This is how the manufacturers and suppliers can complete Annex 5.6 notification and protect CBI. Annex 5.6 notification is the only reliable way to nominate chemicals for inclusion into the existing chemicals inventory at present. However, it could take DIW 1-2 months to issue a CBI consultation number because they have to review the materials manually, so the approaching deadline must also be considered.
