On March 4, 2022, Thailand’s Department of Industrial Works (DIW) announced to solicit public comments on the draft Notification of the Department of Industrial Works Re: Criteria for the Consideration of Hazard Properties under the Annex 5.6 of the List of Hazardous Substances under Authorization of the Department of Industrial Works (hereinafter referred to as Notification), which was drafted according to the Notification on the List of Hazardous Substances (No. 2) B.E. 2558 (2015) and the Hazardous Substance Act B.E. 2535 (1992). The consultation will end on March 25, 2022. Once approved, this regulation will come into force ninety days from the date of its publication on the Government Gazette.
Annex 5.6 includes groups of hazardous substances controlled by DIW as per 10 hazard properties, including:
Explosive
Flammable substance
Oxidizing agent or Peroxide
Toxic substance
Mutagen
Corrosive
Irritant
Carcinogen
Toxic to reproductive organ
Environmentally hazardous substance
Substances that fall into any of the foregoing 10 hazard properties need to be notified if they are produced/imported over 1 ton/year.
Consistent with the Globally Humorized System of Classification and Labelling of Chemicals (the third revised edition of UN GHS 2009), Thailand DIW recently published the Notification to clarify the criteria for the 10 hazard properties under Annex 5.6. Substances and mixtures that haven't been controlled under other regulations nor listed on Annex 1, 2, 3, 4, 5.1~5.5, 6 (regulated by other agencies) shall be classified as per the detailed criteria in the Notification and the UN GHS Rev.3, so that to determine whether they shall be notified as Annex 5.6 hazardous substances and comply with the corresponding obligations or not.
