On December 2, 2019, Thailand Department of Industrial Work (DIW) issued a Notice [1], whose subject is rules, procedures, and conditions for requesting permission to transport hazardous substances. The requirements for the notification of hazardous substances transitting in Thailand were put forward in the fourth edition of the revised Hazardous Substances Act [2], which came into effect in October last year. The issuance of the Notice could help promote the implementation of the transit notification and standardize the permission licensing.
The Notice is divided into three chapters, namely, the general rules, the procedures to review notification or licensing and conditions to approve, and amending or modifying projects in process.
According to the Notice, the transit of type 1 or type 2 hazardous substances requires notification to the DIW officer in the format of WoAo/AoKor 26, which is an annex to the Notice. And the transit of type 3 hazardous substances shall apply for permission from the administration in the format of WoAo/AoKor 27, which is also attached in the Notice. The above forms could be submitted in person at the DIW office or via the online system, and the applications shall be approved within 15 working days. If the authority considers to rejects the application or refuse to approve, the applicant shall be informed within seven working days. The approval for the transit of type 1 or type 2 hazardous substances should be in the format of WoAo/AoKor 26, and for type 3 hazardous substances, it should be in the format of WoAo/AoKor 28. It is worth noting that the waybills shall be carried together when collecting the transit approval document.
The Notice also requires applicants to provide insurance against possible damage caused by hazardous substances. The amount of insurance should not be less than 100,000 THB. For the hazardous substances in sub-list 5.2, the amount shall be no less than 500,000 THB. Applicants can apply for an insurance refund after the export of the hazardous substances and return of the transit declaration documents to DIW.
