On March 2nd, 2021, Thailand issued the Notification of Ministry of Industry Subject: Declaration of the hazardous substances under the authorization of Department of Industrial Works by producer, importer, exporter or possessor (No.2) B.E. 2563 [1] on the government gazette. The draft of the Notification was published last April for public comments (ChemLinked News [2]). The Notification was approved in February and entered into effect the day after its issuance on the government gazette.
The Notification on the declaration was issued for the first time in 2000 and amended in 2004 [3]. It requires that the declaration of hazardous substances under the authorization of DIW by producer, importer, exporter, or possessor should be submitted every half a year. A list of hazardous substances is annexed to the notification, specifying the scope of the declaration. The list includes 47 substances in the 2000 version and includes 53 substances in the 2004 version. The information on the hazardous substances should be declared to the authority, including chemical formula, trade name, quantity, and so on.
In the Notification on the Declaration (No.2), paragraph 1 of Article 4 is updated, which details the declaration. In addition, the annexed list of hazardous substances is expanded, now 206 substances from Sub-list 5 of the List of Hazardous Substances under the Hazardous Substance Act are included. According to Notification (No.2), the declaration is required when the volume of a listed hazardous substance that is manufactured imported, exported, or possessed exceeds 100kg per half-year. The hazard type or the permit code is also required when declaration and the new declaration templates are provided in the Notification (No.2).
