The UK Government recently announced the plan to revoke Annex VIII of EU CLP (Classification, Labelling and Packaging) by the end of 2023. This annex requires companies to submit relevant information on hazardous materials placed on the market to responsible bodies, in order to formulate preventative and curative measures in case of accidents. Once the revocation process is complete, UK companies will no longer be required to submit the Poison Centre Notification (PCN) in the harmonized format to the National Poisons Information Service (NPIS).
The Department of Health and Social Care (DHSC) is the authority responsible for this issue in the UK and will provide further updates on the revocation process. At present, Annex VIII remains applicable in the UK.
Background
The UK left the European Union on January 31, 2020. The Retained EU Law (Revocation and Reform) Bill allows the United Kingdom to take steps in reasserting the sovereignty of Parliament. The UK government has already revoked or reformed over 1,000 EU laws since the EU exit. By an announcement issued on May 10, 2023, the UK government made public a list of 587 retained EU laws that will be revoked or sunset by December 31, 2023. Almost all these laws will be automatically revoked at the end of 2023 unless a statutory instrument is passed to preserve it.
Annex VIII of EU CLP is one of the 587 retained EU laws that will be revoked. The government intends not to retain this annex following the UK’s departure from the EU. However, in February 2023, the DHSC inadvertently adopted it into Great Britain (GB) CLP. The adoption has been discussed and debated internally within the UK Government. The recent announcement confirms the plan to revoke this annex by December 31, 2023.
