Vietnam Consults on the Amendment of Decree No.113/2017/ND-CP under the Law on Chemicals

The amendment focuses on the declaration of imported chemicals, chemical accident response, and industrial chemicals management, etc.

On July 9th, 2021, the Vietnam Chemical Agency under the Ministry of Industry and Trade (MOIT) issued a notice [1] to collect opinions on the amendment and supplement of articles of Decree No.113/2017/ND-CP: Detailed regulations and guidance on the implementation of a number of articles of the Law on Chemicals. The public can submit their comments on the draft amendment on the website, where the draft, amendment introduction, and amendment background documents (in Vietnamese) can be downloaded.

The amendment and supplement of articles of the Decree were expected to focus on solving the following issues:

  1. The declaration of imported chemicals;

  2. Plan/preventive measures for chemical incident response;

  3. The chemicals subject to conditional production and trading in the industrial sector, the restricted chemicals of production and trading in the industrial sector, and other related issues (regulative scope, applicable targets, words interpretation, ...);

  4. Management of industrial precursors;

  5. Chemical safety training;

  6. Chemical activity reporting mode;

  7. Chemical inventory.

This April, the Vietnam Chemical Agency issued a notice [2] to announce the amendment to the Law on Chemicals and publish a questionnaire to investigate the implementation of the Law from the industry. In the questionnaire, enterprises’ understanding of chemical management regulations and guidance documents was surveyed, as well as their opinions on whether the guidance documents meet actual needs, and whether the scope of application and word interpretation are appropriate. In addition, the implementation of management of conditional chemicals and restricted chemicals, declaration of imported chemicals, and emergency response plan, etc. were investigated, which are emphasized in the amendment of the Decree.

The questionnaire also reflects other aspects that the amendment of the Law on Chemicals will focus on, such as the sales control of toxic chemicals, the development of chemical inventories, etc. More details on the amendment of Vietnam chemical management regulations may be published in the second half of this year, please stay tuned.
