Vietnam Implements New POPs Regulations under Decree No. 08/2022/ND-CP of LEP

On November 17, 2020, Vietnam released the revised Law on Environmental Protection (2020 LEP) to replace its 2014 version. The 2020 LEP took effect on January 1, 2022. Besides some notable new changes concerning environmental impact assessment, environment permits and registration, environmental audit, etc., the law adopts new requirements on persistent organic pollutants (POPs) and raw materials, fuels, materials, products, goods and equipment containing POPs (hereinafter "products containing POPs"). This is in line with Vietnam’s commitment to protect the environment under UN Stockholm Convention.  

Detailed requirements for the control of POPs and POPs-containing products are provided in the Government Decree No. 08/2022/ND-CP Detailing a Number of Articles of the Law on Environmental Protection[1] (hereinafter referred to as the Decree) and the Ministry of Natural Resources and Environment (MONRE)’s Circular No. 02/2022/TT-BTNMT on Implementation Rules for a Number of Articles of the Law on Environmental Protection[2] (hereinafter referred to as the Circular). Both of them took effect on January 10, 2022.

More specifically, the Decree and the Implementation Rules stipulate the obligations for importers, manufactures and operators, e.g. application for the registration exemption of POPs under the Stockholm Convention, labeling, information disclosure, as well as the management responsibilities of relevant parties, e.g. conformity assessment and inspection for POPs and POPs-containing products..
