Vietnam Issues Decree No. 111/2021/ND-CP with New Rules for Goods Labeling

Goods exported from Vietnam require labeling under Decree No. 111/2021/ND-CP. In case of origin of goods unable to be identified, the country or region where the last stage of finishing the goods is performed shall be presented on the label.

On December 9, 2021, the Government of Vietnam issued Decree No. 111/2021/ND-CP amending and supplementing Decree No. 43/2017/ND-CP on goods labeling. The Decree will take effect on February 15, 2022.

Decree No. 43/2017/ND-CP was issued on April 14, 2017 to replace the Government Decree No. 89/2006/ND-CP dated August 30, 2006. It took effect on June 1, 2017, with coverage limited to goods imported and circulated in Vietnam. However, by Decree No. 111/2021/ND-CP, the applicable scope is expanded to include goods for export. New requirements are added to indicate the country or region where to complete products if origin of goods cannot be identified. In addition, good labels can be presented electronically. The Minister of Science and Technology will promulgate guidance on electronic labeling.

New labeling information for goods for export

Goods exported from Vietnam are required to be labeled according to the law of import country:

  1. Information about origins written on labels of exports shall comply with the regulations prescribed in Clause 1 Article 15 of this Decree;

  2.  Information on labels of exports shall comply with the regulation in Clause 2 Article 18 of this Decree

Languages of goods labels

Mandatory information on the label must be written in Vietnamese. However, goods that are not consumed domestically can be exempted.

Origins of goods

Manufacturers, importers and exporters shall identify the origin of their goods and indicate it on labels in compliance with the Vietnam’s law or international treaties to which Vietnam has acceded. Phrases, e.g. "made in", "country of manufacture", "origin", "manufactured by" can be used. If the origin of goods cannot be identified, the place where the final stage is conducted to finish goods shall be indicated following the phrases , e.g.“assembled in", "bottled in", "mixed in", "finished in", "packed in" or "labeled in". The country or region where the good is produced or completed shall not be in abbreviated forms.

Transitional provisions 

  • Goods manufactured, imported or circulated with labels in compliance with Decree No. 43/2017/ND-CP before the effective date of Decree No. 111/2021/ND-CP shall continue to be circulated and consumed until their expiry date.

  • Labels and packages affixed with labels prepared in compliance with Decree No. 43/2017/ND-CP before the effective date of Decree No. 111/2021/ND-CP can still be used for manufactured goods for up to 2 more years (i.e., by February 15, 2024).
