Vietnam to Revise Circular No. 32/2017/TT-BCT for Implementation of Law on Chemicals


On April 28, 2022, Vietnam Ministry of Industry and Trade (MOIT) issued draft amendments to the Circular No. 32/2017/TT-BCT which was effective on December 28, 2017 as implementation guidelines to the Decree No. 113/2017/ND-CP and the Law on Chemicals. Comments are welcome before June 26, 2022.

In 2021, the Vietnam Chemical Agency conducted a survey on the implementation of the Law on Chemical, especially on enterprises’ opinions on whether the guidance documents meet actual needs, and the solutions to improve the management efficiency and feasibility of the Law, etc. Based on the survey results, amendments on Circular No. 32/2017/TT-BCT are drafted. Highlights are summarized as below:

  • Revising format of purchase and sale of toxic chemicals forms.

  • Revising expiration date of the license for manufacture and trade of restricted chemicals to “five years from the date of issuance”.

  • Revising labeling elements to be in line with the requirements in Decree No. 43/2017/ND-CP on goods labeling, Decree 42/2020/ND-CP on transportation of dangerous goods, etc. Labels shall include:

a) Chemical name;

b) Chemical identification code (if any);

c) Warning graphics, warning statements (if any);

d) Precaution measures (if any);

e) Quantitative components or ingredients;

g) Production date;

h) Expiry date (if any);

i) Names and addresses of entities responsible for chemicals;

k) Origin of chemicals;

l) Use instruction, storage condition.

  • Revising warning signs for transportation of dangerous chemicals to comply with mandatory requirements in the Decree 42/2020/ND-CP on transportation of dangerous goods on roads or inland waterways

  • Revising deadline for submitting annual report of chemical activities from January 15 to February 15 each year and updating the format for annual reporting (Appendix 5). In addition, a provision will be added to include chemicals containing 0.1% or more of hazardous chemicals into the scope of annual reporting.

  • Adding guidance for preparation of management logbook for manufacture, trade, and use of industrial precursors (Appendix 11).
