Thailand Specifies Requirements for Declaration of Hazardous Substances under the Authorization of DIW

The draft specifies that a declaration is required when the stakeholders engage in storage, manufacturing, import, export activities above 100kg per half-year. The list of hazardous substances that are subject to the declaration has been updated.

Thailand DIW Consults on 3 Implementation Specifications under the Hazardous Substance Act
Apr 16, 2020
Thailand DIW is currently consulting on three draft regulations under HAS, which includes: the exemption conditions under the Act, the exemption conditions of List 5.6 substances, and the inclusion criteria for List 5.6 Hazardous Substance. The consultation will conclude on April 30. Online submission, telephone feedback, and email feedback are all available.

Brief on Thailand's Chemical Management Work Plan

Speaking at ChemCon held in Philadelphia on March 5, 2020, Caroline Li from ExxonMobil Asia Pacific Pte. Ltd mentioned Thailand’s chemical management work plan for the next few years. Details were also offered on the notification requirements for hazardous substances in List 5.6 and planned to phase-out some plastic products.

Brief on Recent Developments in Thailand’s Hazardous Substance Act

Hazardous Substance Act (HSA) is the most major chemical regulation in Thailand, which has been revised four times since it was released in 1992. In April 2019, Thailand released the Hazardous Substance Act (No.4), which will take effect on 27th October 2019. The fourth revision focused on stating the definition of “transit” and separating it from “import” and speeding up the customs process by reducing repeat steps.

On 11 Mar, Thailand’s Department of Industrial Works (DIW) issued a notice (B.E.2562), consulting on a proposal to make some changes to the List of Hazardous Substances under the Hazardous Substances Control Act (HSCA). The proposed changes are as follows, which relates to Annex 4.1, 4.2 and 5.1.

On Feb 19th, 2015, Ministry of Industry (MOI) published a notification pertaining to the List of Hazardous Substances (No. 2) B.E. 2558 (2015). According to the notification, manufacturers and importers of chemical substances that meet certain criteria will have to notify chemical substances to the Department of Industrial Works (DIW).
