Thailand DIW to Update the List of Hazardous Substances under Hazardous Substances Act

On March 31, 2022, Thailand’s Department of Industrial Works (DIW) notified WTO of the draft amendments to the List of Hazardous Substances under the Hazardous Substances Act (Notification G/TBT/N/THA/659) for comments until May 31, 2022. As per the Notification, the DIW drafted some amendments to revise and add certain hazardous substances on the List of Hazardous Substances.

On February 11, 2022, Thailand’s Department of Industrial Works (DIW) announced to solicit public comments for the draft amendments to the Ministerial Regulation B.E 2537 (1994) issued under Hazardous Substance Act B.E. 2535 (1992), prescribing rules on the application for, or the issuance/modification of the permit of import/export/production/possession of Type 3 hazardous substance via online system.

Thailand DIW Consults on Adding PFOA, Its salts, and PFOA-related Compounds to the List of Hazardous Substances

On February 9, 2022, Thailand’s Department of Industrial Works (DIW) issued a notice to solicit public comments on adding PFOA, its salts, and PFOA-related compounds (eight substances) to the Annex 5.1 of the List of Hazardous Substances. In addition, they will be classified as Type 3 and Type 4 substances due to specific conditions. The consultation will due on February 25, 2022.

Thailand Issues A New Draft of the Chemical Substance Act

The number of articles of the Act has increased from 100 to 108, provisions on exemption conditions and management on special chemical substances are added, and specifications on chemical substances assessment and legal responsibilities are detailed. The rights and responsibilities of relevant administrations are further clarified, and transitional provisions for materials that are not chemical substances are specified as well.

Thailand FDA to Further Standardize the Management on Transit of Hazardous Substances

FDA drafted a notification to specify the application, approval and change of transit license of hazardous substances for the better implementation of relevant requirements in HSA No.4. The consultation period will conclude on December 15th, 2020. The application and permission forms are provided as attachments for enterprises to refer to.

WTO Notifies Thailand’s Amendment to the List of Hazardous Substances (Updated)

In conclusion, the above 5 chemicals are proposed to be changed to Type 4, which means they will be totally prohibited. What’s more, the exemption condition for Chlorpyrifos, Chlorpyrifos-methyl and Paraquat dichloride are repealed as well.

Thailand Specifies Requirements for Declaration of Hazardous Substances under the Authorization of DIW
Apr 29, 2020
The draft specifies that a declaration is required when the stakeholders engage in storage, manufacturing, import, export activities above 100kg per half-year. The list of hazardous substances that are subject to the declaration has been updated.
